I have the privilege to give the invocation at the Lancaster for Liberty Tea Party taking place in Lancaster County Park from 1-5PM.  They asked me after seeing the prayer controversy at the House.  Here is the prayer I will deliver:

Gracious God and loving Lord, we come before you this afternoon to celebrate the good work of Lancaster for Liberty and for the dozens of people who will gather here today. We are encouraged by the fact that there are people who are compelled to labor on behalf of their fellow citizens and promote the kind of change as outlined in the principles of your Old and New Testament, thus lifting up your righteous conscience.
 
We are reminded what your holy word says: “Righteousness exalts a nation, but sin is a disgrace to any people.” Sadly, our nation stands in disgrace this day because of our willful sin, and simply from failing to acknowledge your righteousness. The heavens declared your glory; yet we have dismissed the idea of there being a Creator. Human life mirrors your glory; yet we have devalued the life that comes from your breath. Your scriptures tell us about your glory; yet some have said there is no truth and have silenced your sovereign Word. Your people have failed to proclaim your righteousness in the midst of a dark and depraved world. Forgive us.
 
Yet with great HOPE, Father, we believe that if we declare your truth and stand for your righteousness true CHANGE could come: We believe…
-         Your righteousness can beat back the corruption which permeates politics.
-         Your righteousness can reveal truth even though lies are confidently and constantly spoken from the lips of our leaders.
-         Your righteousness can humble the proud and the haughty that refuse to answer questions and attempt to live beyond accountability.
-         Your righteousness can expose the darkness of back rooms where decisions are done in secret and deals are made away from the purview of the citizenry.
-         Your righteousness can rebuke the false accusations of national leaders who attempt to cause racial agitation.
-         Your righteousness can make right undisciplined use of taxpayer’s funds which are sacrificed to satisfy political favors.
-         Your righteousness can lay bare community organizers who use their charitable trust to encourage criminal activity and vile immorality.
-         Your righteousness can unite the hearts of political foes to solve a state budget impasse and set a course of fiscal responsibility.
-         Your righteousness can melt the heart of any abortionist, pornographer, homosexual, embezzler, and anyone else who would gleefully support and encourage these offenses to you and your character.
 
God, make your righteousness known to all the earth and use your people to make it known. Give us boldness, wisdom, endless creativity, passion, and unwavering steadfastness, even in the midst of opposition. But first and foremost, let your righteousness fall on us and manifest itself in us. Let your judgment begin first in the household of faith. Root out our iniquity. Remove our apathy. Revitalize your people to be clarions of your righteousness. Let each of us who admire your righteousness, carry the burden of being an announcer of that righteousness. God help us.
 
Finally, I pray for all our elected officials who desire to see change come in our nation. We admire their courage to stand up for the truth and attempt to hold back the tide of erosion and devastation upon our national identity. Yet I pray that they will do this by pursuing righteousness personally; proclaiming righteousness publicly, and protecting righteousness passionately. Reveal any unrighteousness in them so that they may be right with you and above reproach in the eyes of those they serve. May they choose the narrow way which leads to life. May they have the faith of Abraham, the courage of Daniel, the truthfulness of Nathan, the wisdom of Solomon, the boldness of John the Baptist, and the diligence of Paul. Lord, show them your favor. Place a hedge of protection around their spouses and children. Protect them from any evil.
 
We thank you for the privilege of prayer. Bless this day’s events, for your honor and glory and the pleasure of the one whose name we pray -  the name of your Son, our living Savior, coming Messiah and reigning Master, Jesus the Christ. Amen.

THERE WAS A STONEY SILENCE AS OBAMA IGNORED THE QUESTION AND CHOSE NOT TO ANSWER IT....
IN ADDITION, A NUMBER OF SENATORS WERE ASKED THE SAME QUESTION AND THEIR RESPONSE WAS..."WE WILL THINK ABOUT IT."
AND THEY DID. IT WAS ANNOUNCED TODAY ON THE NEWS THAT THE "KENNEDY HEALTH CARE BILL” WAS WRITTEN INTO THE NEW HEALTH CARE REFORM INITIATIVE, ENSURING THAT CONGRESS WILL BE 100% EXEMPT! This should speak volumes to all of us.
SO, THIS GREAT NEW HEALTH CARE PLAN THAT IS GOOD FOR YOU AND ME... IS NOT GOOD ENOUGH FOR OBAMA, HIS FAMILY OR CONGRESS...?? WE (THE AMERICAN PUBLIC) NEED TO STOP THIS PROPOSED DEBACLE ASAP!!!!... THIS IS TOTALLY WRONG!!!!! CONGRESS’ HEALTH CARE PLAN ....FOR FREE..... WHILE OUR SELF-SERVING POLITICIANS MAKE SURE THAT THEY TAKE CARE OF THEMSELVES AND THEIR FAMILIES AT OUR EXPENSE. 
 

I launched our ministry year yesterday with VISION SUNDAY.  This is when I lay out the overall vision for the church and any new initiatives for 2009-2010.  Our theme comes from John 15 - Fruit, More Fruit and Much fruit! Jesus told his disciples that by being his disciples it is expected to bear FRUIT.  It is the spiritual result of a life lived in Christ.  When we come to faith, we are spiritually connected to Christ and He lives through us. The net result will be fruit. Whether it is winning the lost, building up other believers, growing the church, demonstrating the fruit of the spirit or giving - Christ expects fruit. But if you look at the passage, Jesus says that His Father is not happy until we bear MUCH fruit and there is a process to get there. You start at fruit....the basics. Then you move to MORE fruit. This is attained when you are pruned or cleansed of those things that hinder your spiritual life and hold back the fruit bearing. Once pruning occurs, it should leave us at a point of greater dependence or as the text says - ABIDING.  When we are at the abiding mode, much fruit will come!  I would encourage you to check out our website www.newsongfellowship.com and listen to the message.  JM

Well just about two weeks post-op and doing great. Yesterday I preached twice and felt no ill affects. Then went back at night and led prayer meeting. I did sleep good last night! Got up early this morning for a 6:30AM doctor's appointment.... total weight loss: 58 lbs (since March); blood pressure: 120/72; great bill of health and a B-12 shot!  Went right to the gym and had a good workout  then home to mow the lawn!  I have over 7000 steps on my pedometer!!!  And the protein shake deal is going well.  I have learned how to mix up shakes, pudding, V8 juice and soups for a varied menu and still getting my 100 grams of protein. All in all, feeling great!  Keep praying - two week check up on Thursday with the surgeon. If all is well I can start lifting weights again - the weight will fly off then. Also I will be on pureed food (oh goody). Listen a mashed yam never sounded so good.  Oh yeah the best thing was the amazing encouragement I received from my church family yesterday.  What a blessing. It is all good!

I have written a number of times on the heresy of Brian McLaren - the godfather of the post-modern/Emergent Church movement. I have quoted him and mentioned about his universalism which he espouses. Today I received another evidence of sloppy separationism and his lack of judgment.  He is encouraging Christians to participate in fasting with Muslims during their Ramadan celebrations.  I especially appreciate Mohler and Driscoll's commments. All I can say is he is an idiot!

Like Muslims worldwide, Ben Ries has refrained from food and drink from sunrise to sundown in an act of self-restraint during the Islamic holy month of Ramadan, which ends this weekend.
Each evening, the 31-year-old Ries joins Muslim families in a room above a hardware store in Bellingham, Wash., to find fellowship and break the fast with a handful of dates and a welcome glass of water.
Only Ries is not a Muslim. He is pastor of 70-member Sterling Drive Church of Christ and a self-described committed Christian who just a few weeks ago had to turn to Google to find a Muslim in his community.
Ries is among a small group of Christians who've joined well-known evangelical author and speaker Brian McLaren in observing a Ramadan fast, opening a new chapter in interfaith relations between two traditions often at odds.
To McLaren and his Christian and Muslim fasting partners, it's a neighborly gesture of solidarity that deepens their respective faiths and sends a message about finding peace and common ground.
But the project also has faced fierce criticism. Some evangelicals say that fasting alongside Muslims at Ramadan, however well-intentioned, is a dangerous blurring of the lines and runs contrary to Christianity.
McLaren, 53, is the godfather of the "emerging" or "emergent" church, a loose-knit movement that seeks to recover ancient Christian worship practices and, in some cases, question traditional evangelical theology.
While fasting is part of Christian tradition, it isn't exactly a widespread practice. Some college students from different faiths have started interfaith "Fast-A-Thons" during Ramadan to raise money to fight poverty. But that usually involves fasting for a day, not committing to an entire month.
In announcing his Ramadan fast plans on his blog last month, McLaren wrote, "We are not doing so in order to become Muslims: we are deeply committed Christians. But as Christians, we want to come close to our Muslim neighbors and to share this important part of life with them." The goal is to join Muslims in the observance as "a God-honoring expression of peace, fellowship and neighborliness," he wrote.
McLaren, a former pastor, said his Ramadan fast is also part of his post-9-11 worldview.
"Some Christians in the U.S. are becoming more anti-Muslim," he said in an interview. "They are retrenching in a fearful, angry posture. Other Christians are saying now, in the aftermath of Sept. 11, we have to recommit ourselves to the work of peacemaking like never before. That has been my response."
Before Ramadan, McLaren sought a Muslim fasting partner. He found one in Eboo Patel, executive director of Chicago-based Interfaith Youth Core, which promotes interfaith cooperation.
Patel said there are important differences in his fast and McLaren's. As a Muslim, Patel said he fasts during Ramadan because the Prophet Muhammad fasted then, and because the first revelation of the Quran occurred that month.
"That is not something Brian shares, at least not in the same way," Patel said.
McLaren said he has discovered a handful of fellow Christians fasting during Ramadan. One has quietly been doing it for more than 20 years. Others are new to it — like Ries in Washington state.
Ries considers the idea consistent with his own efforts to reach out to people who are different. Only problem was, he didn't know any Muslims in Bellingham, a college town of 75,000 on the Northwest coast.
An Internet search introduced him to Monem Salam, the subject of the documentary "On a Wing and a Prayer," which followed Salam's journey of learning to fly and obtaining a pilot's license after Sept. 11.
The two had coffee a couple of days before Ramadan, hit it off, and a fast friendship was born.
"When you have a leader of a church or a community go through the experience of fasting an entire month of Ramadan, what happens is not only does he understand a little more about the Muslim or Islamic culture, but he has the podium, or the pulpit, to teach that to other people as well," said Salam, 37, who works for an investment firm that manages a large Sharia-compliant mutual fund.
Ries had fasted before, but not from water. About two weeks in, he said, his body adjusted. Ries also has been reading the Quran, not for spiritual sustenance but to learn something, he said. Joining the Muslim community to break fast each night has opened this eyes to their graciousness and hospitality, he said.
Ries said he faced questions from some in his flock and criticism from others who read about his fast.
"There is no violation of my own faith in this," Ries said. "The concern is that somehow, I'm endorsing this other path. But I tell people I believe Jesus is the son of God. I believe he is the way and the truth and the life. But I believe I don't get to say who goes to hell and who doesn't. That's God's job."
Of the anger he's encountered from some Christians who object, Ries said: "A major factor is fear ... if we move the line here, we'll move it further, and this is the beginning of the end."
Albert Mohler, president of Southern Baptist Theological Seminary in Louisville, said the idea of Christians fasting at Ramadan appears at first to be neighborly solidarity, but it's more than that.
"The logic of Islam is obedience and submission," Mohler said. "It's by following these practices that a Muslim demonstrates his obedience to the rule of the law through the Quran. For a Christian to do the same automatically implies a submission to the same rule. And beyond that, it's an explicit affirmation that this is a good and holy thing. From a New Testament perspective, it is not a good and holy thing."
Christians should have friendships with people of other faith, but engaging in other traditions' worship practices is problematic, said Mark Driscoll, lead preaching pastor at Mars Hill Church in Seattle. Driscoll said that in this case, Christians and Muslims fast for different purposes and do not worship the same God.
Christians observing a Ramadan fast is "insane at best ... Sad, tragic, horrific, misguided, dangerous, wrong," Driscoll said. "If Christians want to pray during Ramadan, they should pray not with Muslims but for Muslims — that Muslims would come to know Jesus. To pray with Muslims absolutely dishonors Jesus."
There is disagreement among evangelicals about whether Christians and Muslims worship the same God; Muslims believe Jesus was a prophet and a teacher, but not the son of God.
Among Muslims, McLaren's Ramadan fast and invitation to other Christians to join him would be widely welcomed, with a "very small minority" wondering whether it's an effort to infiltrate and convert the Muslim community, said Akbar Ahmed, chairman of the Islamic studies department at American University.
"There is a high level of anti-Americanism in the Muslim world," Ahmed said. "Now they are going to say this propaganda that America hates us is not true. Here is a pastor who wants to understand us, who does not want to convert us, and who is even prepared to walk with us, to fast with us. That is a big gesture."
As Ramadan nears it end, McLaren said his fast has made him more sensitive to people who endure hunger every day without the promise of relief at sundown. And he said the commitment and self-discipline the fast requires has increased his respect for Muslims.
"I have felt Muslims don't want me to compromise and say belief doesn't matter," he said. "They want me to be a faithful Christian — a faithful Christian that doesn't want to destroy all Muslims."
A week and two days later and I am feeling good. The fact is on Monday I went to the gym. I can not do any lifting for another week or two, but rode my bike and used some smaller hand weights.  Then that afternoon I walked four holes at Meadia Heights Golf course for Alex's match -- it felt great!  The food thing is fine. Trying to be creative. Mixing between shakes, soups, pudding, etc... This too shall pass!  Yesterday I experienced "loss of energy" -- had to come home from work and crash for three hours. But felt good enough to go back and teach for an hour!  I preach on Sunday and then back to the doctor next week to move into Phase Two of my food -- PUREED FOODS! Whoa!  Kris bought all the different foodsI can eat next week -- it was like seeing a buffet!!  The support of people has been awesome!  Thanks for all the cards and notes and emails!!  By the way, took off another 10 lbs - 51 total!  JM
A vehicle at 15 mpg and 12,000 miles per year uses 800 gallons a
year of gasoline.
· A vehicle at 25 mpg and 12,000 miles per year uses 480 gallons a
year.
· So, the average clunker transaction will reduce US gasoline
consumption by 320 gallons per year.
· They claim 700,000 vehicles - so that's 224 million gallons / year.
· That equates to a bit over 5 million barrels of oil.
· 5 million barrels of oil is about 1/4 of one day's US consumption.
· And, 5 million barrels of oil costs about $350 million dollars at
$70/bbl.
· So, all of us taxpayers contributed $3 billion to save $350 million a year?
How good a deal was that???
Oh yes, we borrowed the $3 billion from China, so we are paying them $100 million a year in interest.


He never lets me down. James MacDonald always speaks truth and hits an issue right between the eyes. This time he handles the issue of weak or passive leadership. This resonates with our hearts at NewSong. This is why we love this guy so much!  Go James!

Leading is lonely at times, no question about it. If you’re doing the job God has given you, the loneliness cannot be avoided.
Looking back I think I was a little too hard on leaders who didn’t deal with things. Not that I ever said much as a youth pastor or singles pastor. Not that I stormed into the president’s office as a Bible college and seminary student; I mostly kept my thoughts to myself. But I remember immense dismay as I watched and experienced obvious institutional issues go unaddressed. I remember great perplexity at the damage their avoidance was doing to the mission. Did they not see it? Or were they afraid to deal with it? I just couldn’t make up my mind. Why the passivity, why the lack of leadership and intentional problem solving? I just couldn’t figure it out. How could they see it and not deal with it . . . They MUST not see it, I often concluded.
But I have changed my opinion. More often that not I think leaders DO see the things that need to be done. They observe the underperforming personnel that need to be reseated or relocated or removed. They totally know about the attitudinal issues that call out to be confronted as they do damage to morale and momentum. They comprehend completely the outdated structures and board governance gridlocks that are paralyzing upward movement of fresh innovation and new perspectives. THEY SEE IT ALL, but they are unwilling to pay the price to address it.
The price? Misunderstanding and isolation from those losing control. Uncertainty and distance even from some who remain but legitimately struggle with the gap between what is good for the organization as a whole and what is good for our ongoing pastoral mission with the families involved. Personal attack by those who struggle to accept that their own participation in the mission is not more important than the mission itself. Especially difficult in all of this is the pressure to continue publicly without affect while the residue of these issues is not yet processed in your own heart.
Wow, was I ever wrong about the leaders I observed as a young man. FOR SUREthey saw the things they needed to address but they concluded that the cost was just not worth it. As for me I was the one who was blind. I had no real concept of the personal impact courageous organizational leadership demands. I didn’t calculate accurately how quickly people can flip from focusing on what is wrong with the organization to what is wrong with the people who threaten their role. I know now though, and I am a lot more sympathetic to the leaders who choose to ‘leave it alone.’
I understand their choice, I just don’t respect it.

It's Thursday AM and I just got the OK to head home.  Feeling good and all the plumbing is working (enough said!). The next few weeks will be tough - two weeks of full liquids....two weeks of puréed food (baby food)....two weeks of soft foods.  The positive aspect of this is that I could lose about 40 lbs during these next six weeks.  All in all, I'm doing well!  Thanks for all the prayers and concerns.

Tomorrow morning, (Tuesday, September 8th at 6AM) I will be in Lancaster General Hospital prepping for gastric bypass surgery. As those of you who know me and have been in my presence -- I am a big man. I have been a big man for years. Look I was 11lb 4oz at birth!  There are probably all kinds of reasons why I am overweight and trust me I have reviewed each one, yet over the past ten years I have tried to have a sustained weight loss and have had little success. I lose and then gain it back. The fact is I have been able to carry the weight and do a lot of things most overweight people can’t do. I have stayed active, athletic and fortunately have not had any “major” injuries.  However, it is not a healthy way to live. Statistics tell us, your chances for long term medical issues and a shortened life is greater being overweight.
There are lifestyle issues that play into this struggle. Physical, nutritional, schedules, eating habits, exercise limitations, discipline and others.  Shear will-power is not a problem, even though I admit having succumbed many times when cheesecake is brought out. What I learned this past year was eye-opening. The most telling fact is that if you need to lose the amount of weight I need to, a conventional diet/exercise routine just does not cut it and you will have temporary success, but not long-term results.  I have thought about Biggest Loser, but my time commitment to ministry would not allow for a 15-week sabbatical. I cannot afford to have a personal trainer or have a dietician/chef move in (and my wife would not allow it). The fact is bariatric surgery is the best and most effective way to go at my age. Again this is a personal and prayerful decision, and the right way to go for me.
Since last summer, I have been thinking about the possibility. I began researching, reading, talking with people, especially medical people in our church, and surfing the web. I discovered that LGH has a growing and highly touted program. So much so, that it recently invested millions of dollars in a new weight management clinic at the Health Campus. Basically what happens is that my stomach is reduced in size, thus causing me to feel satisfied and not hungry on less food. This will "trick" my body into thinking that I have enough calories, but in reality it causes my body to burn stored fat rapidly. Obviously, you have to supplement your diet with vitamins, minerals and the ever-present protein shakes! (The fact is they are incredibly delicious.)
In January, I attended a seminar to investigate and was astonished at what I learned. After consultation with the surgeon, it was determined that I was a candidate. Since March, I have been watching what, when, how often and how much I eat and increased my exercise routine to five days a week.  By God's grace, I have lost 40lbs and the doctor is thrilled.  By the way Dr. Brader, my surgeon, is tops in this field. He has performed this surgery thousands of times with remarkable success. His “best case” prediction is that I will lose another 115-120lbs in a year’s time!  At that point, your body begins to “level out” and maintain. Who knows, with that kind of weight loss I might try out for the Giants as a walk-on wide receiver for the 2010 season -- I still have great hands! 
All in all, I will be healthier, and therefore, "extend my days on earth."  I recognize that God holds my life in His hands and when He wants my life to end -- it will be done!  Nevertheless, I have the responsibility to NOT shorten my life and to maximize my days by living healthy and taking responsibility for things like my weight. I am reminded what Paul said: “Or do you not know that your body is a temple of the Holy Spirit who is in you, whom you have from God, and that you are not your own? For you have been bought with a price: therefore glorify God in your body.” (1 Corinthians 6:19-20)  If being healthier gives me more days to serve God with all my heart, mind and soul; then I bring more glory to God!
You are probably asking, ultimately why are you doing this? A number of personal reasons.... I want to see my son graduate from college...... I want to be a part of his wedding..... I want to hold my grandchildren (hopefully the previous event will take place prior to the second).....I want to get old and cantankerous with my wife!  All of those are legitimate and important. They have significance to me in that my father never got to enjoy any of those things and he was not overweight!
And of course, again the most important reason; I want to live an active, effective and fuller life to bear more spiritual fruit...NO -- MUCH MORE FRUIT for the Lord. In doing this, I get to serve the Lord with my maximum ability and optimize life for His glory!  Not to mention, I want to lighten the Lord’s load in heaven when the time comes to give me a glorified body. I understand that He has discontinued His Heavenly “Cash for Clunkers” program!!!
So, pray for me Tuesday....you're probably wondering why I did not mention this in service yesterday? Two reasons....with so many visitors and new people, I would have had to take extra time to explain it and I did not want to take time from worship or the teaching. Secondly, many who have heard, or to those I mentioned that I was having the procedure have been asking me “why...how come...are you sure?” This is fine – completely understandable. To be honest, I am overwhelmed by your concern. But I did not want that to be the focal point of our Lord’s Day. Plus many are away with the holiday.  I figured an email would clarify and inform you of all the details necessary at one time. 
Sorry to say, I will not be at the Kick-Off BBQ. This is my first absence in 11 years of barbeques. I will be home recovering. BUT we had already planned to have Pastor Bill Hiestand from Crossings Community Church preaching. You will have a great day as he will be sharing about “True Hope!” I will be back in the pocket the following week. I will give you some further details on my surgery during my Vision Sunday message. I have to tell you I am so excited about this year and our theme for the year, “Fruit, MORE Fruit, MUCH Fruit.” I will have some testimonies and illustrations on what this theme means PLUS will be announcing some new ministries we are rolling out this coming year. EVERY NEWSONGER needs to be present.

Since March I have been watching what, and how much, I eat and exercising five days a week.  By God's grace I have lost 40lbs and the doctors are thrilled.  The best case guess, and Dr. Brader is tops in this field, he is predicting another 115-120lbs in a year!  I might try out for the Giants as a walk-on as a wide receiver -- I still have great hands!  All in all, I will be much more healthy and therefore "extend my days on earth."  So why am I doing this?  Simple -- I want to see my son graduate from college; be apart of his wedding, hold my grandchildren and get old and cantankerous with my wife!  But most importantly I want to bear more fruit...MUCH MORE FRUIT for the Lord.  I recognize that God holds my life in His hands and when He wants my life to end -- it will be!  But I have the responsibility to NOT shorten my life and living healthy and responsibly.  In doing so I get to serve the Lord with my maximum effort and optimum life!  So, pray for me next Tuesday....and if you are planning to buy me a Christmas gift - make it cash so I can buy some new clothes!!
HOUSE DEMOCRATS’ COSTLY HEALTH SCHEME A BOON TO UNIONS, TRIAL LAWYERS, AND EVEN ACORN

If a government takeover of health care at the expense of America’s seniors, middle class and small businesses wasn’t enough, Democrats also decided to load up their costly bill with special-interest giveaways to help their labor union, trial lawyer, and ACORN friends.  It’s no wonder the American people increasingly oppose the proposal put together by President Obama, Speaker Nancy Pelosi (D-CA), and House Democratic leaders.  House Republican Leader John Boehner (R-OH) responded today:
“Chock full of liberal special-interest giveaways, it’s no wonder public support for the Democrats’ government takeover of health care is plummeting.  American seniors, families and small businesses should not be sacrificed at the expense of trial lawyers, unions, and even ACORN.  It’s time to scrap the current bill and start working together on a common-sense plan to lower costs and increase access to quality health care.”

Written in a backroom, it’s easy to understand why the House Democrats’ bill provides numerous giveaways to special-interest groups and their allies.  Here are just a few examples:
  • Page 95; Section 205 – The bill directs the “Health Choices Commissioner” to conduct outreach activities, including through the use of outside organizations such as ACORN and others, to reach out and enroll exchange-eligible individuals and employers.
  • Page 31-32; Section 123(a)(5) – The bill requires that the Health Benefits Advisory Committee include labor unions.  This advisory committee would be charged with recommending covered benefits for essential, enhanced, and premium plans.  Although the reference to ‘labor’ does not necessarily require a union representative or a unionized employee on the committee, the choice of that word as opposed to ‘employees’ suggests that organized labor would likely be assured a position on the advisory committee.
  • Page 53; Section 154 – The bill ensures that the new federal health care program will set a floor (but not a ceiling) for health care negotiations for unionized employers.  The legislation cannot be construed to excuse them from good-faith bargaining over health care benefits.  Furthermore, it will not permit unionized employers to unilaterally drop health coverage of its employees in favor of shunting them into the government-run plan or simply paying the penalty associated with not offering health care benefits to workers. 
  • Pages 533-551; Section 1412 – The bill requires the Comptroller General of the U.S. to conduct a study examining: “(A) the extent to which corporations that own or operate large numbers of nursing facilities … are undercapitalizing such facilities; (B) the effects of such undercapitalization on quality of care, including staffing and food costs, at such facilities; (C) options to address such undercapitalization, such as requirements relating to surety bonds, liability insurance, or minimum capitalization.”  This provision primarily benefits trial lawyers who sue nursing homes.
  • Pages 551-569; Section 1413 – The bill requires HHS to include certain kinds of information about nursing home facilities and skilled nursing facilities on its website, including staffing, turnover, and tenure data for each facility.  It also requires the HHS Secretary to consult with labor unions representing workers at the facility in reviewing the information.  By giving labor unions a voice in deciding what information will appear on the website, the bill creates an opportunity for the unions to drive their staffing or other agendas.
  • Pages 1007-1017; Sec. 2531 – The bill establishes labor union grants for the training of nurses through a partnership grant program that would award grants for collaborative programs between staff nurse organizations, health care providers, and accredited schools of nursing. Except for nursing schools, entities must work with labor unions in order to meet the eligibility requirements for receiving grant funds.  Not only do these grants have to go to joint union-run programs (unless they go directly to nursing schools), but the bill further restricts eligibility for the grants to health care employers, which pay prevailing wages and subsidize the costs of their employees’ participating in these training programs. To the extent the grant program is effective, nursing shortages will become worse in non-unionized hospitals than in unionized hospitals.  These training programs will also provide unions with access to future nurses before they even complete their training, which could make it easier for the unions to organize those nurses in the future—either because of gratitude for the union’s involvement in providing their training, or else simply due to their early access to the employees.
The American people shouldn’t be sacrificed to line the pockets of liberal, special-interest groups; they don’t want a government takeover of their health care; and they want common sense reforms to lower health care costs and increase access for those who don’t currently have health care coverage.  Shouldn’t Democrats work with Republicans on common sense solutions to deliver on the reforms the American people expect and deserve?
